letter must contain all of the following: 1. A persuasive argument which clearly states how you believe
the board should move forward. 2. Which key stakeholders you spoke with before making your decision
and why. 3.The best- and worst-case scenarios which might may arise from your decision. 4. Your
proposed statement to the press. (No more than 250 words)

Instructions:

You are the President of the Board of Directors at a large nonprofit arts organization whose budget is $10 million a year.  You just completed a very public fundraising campaign to repair your aging building that brought in $2 million.  Three months after the campaign ends, you receive a phone call from a local reporter that they have a very credible whistleblower who has evidence that your artistic director has been creating a hostile work environment.  The newspaper will be publishing the story at the end of the week.  Before the story prints you have two choices.

  1. Keep the Artistic Director
  2. Fire the Artistic Director

Some things to note.

  1. The Artistic Director has a contract which does not expire until 2025.  You can fire him, but the contract states, he would get $250,000 for each year left on his contract and the terms of his severance would be covered by a nondisclosure agreement (neither you nor the AD would be allowed to talk about it with anyone).
  2. The funds you raised for the capital campaign legally can only be used for their original purpose, but if you pay off the Artistic Director, the public will believe you spent those funds on ending his contract.
  3. You do not know anything about the allegations other than that the reporter has a reputation for honesty and integrity.  This also isn’t the first time you have heard about the AD’s “management style”.  This means, you believe the allegations to be true.
  4. Your organization has a staff of 100 persons some of whom are part time and also work and other arts organizations in the city.
  5. No matter what you decide, you will have to make some statement to the press. Even if that statement is “no comment.”
  6. The Artistic Director will not agree to anything other than what is in his contract.
